Introduction

Sleep Solutions, Inc. and its subsidiaries (“Sleep Solutions”) owns and operates the website (the “Website”) located at www.springsleep.com  and may operate a Spring Sleep or Sleep Solutions mobile application (collectively, the “Platform”). Your access and use of any part of the Platform, including its content, or any products or services provided through the Platform or otherwise by Sleep Solutions or any affiliated website, software or application (collectively referred to herein as the “Service”) are subject to this Privacy Policy unless specifically stated otherwise. Capitalized terms not otherwise defined have the same meaning as set forth in the Sleep Solutions Terms and Conditions (“Terms and Conditions”).

Sleep Solutions is committed to respecting the privacy of users of the Service. This Privacy Policy (“Privacy Policy”) has been created to inform you of how Sleep Solutions collects, uses, and discloses information in order to provide the Service.

By creating, registering, or logging into an account via the Service, or otherwise accessing or using the Service, you acknowledge and agree to the most recent version of this Privacy Policy. Sleep Solutions may update this Privacy Policy whenever it deems suitable in order to reflect changes in the Service or how Sleep Solutions uses personal information, or as may be required by applicable law.

If Sleep Solutions make any changes to its Privacy Policy, Sleep Solutions will post the revised Privacy Policy and update the “Last updated” date at the top of the Privacy Policy. If Sleep Solutions make material changes to this Privacy Policy, Sleep Solutions will provide notice or obtain consent regarding such changes as may be required by law.

If you are using the Service on behalf of another person, you represent and acknowledge that you are authorized by such an person to act on their behalf and that they acknowledge the practices and policies outlined in this Privacy Policy.

Protected Information

When you set up an account with Sleep Solutions, you are creating a direct customer relationship with Sleep Solutions that enables you to access and/or utilize the various functions of the Platform and the Service as a user. As part of that relationship, you provide information to Sleep Solutions, including but not limited to, your name, email address, shipping address, phone number and certain transactional information, which Sleep Solutions do not consider to be “protected health information” or “medical information.”

However, in using certain components of the Service, you may provide certain health or medical information that may be protected under applicable laws. Sleep Solutions is not a “covered entity” under the Health Insurance Portability and Accountability Act of 1996, Public Law 104-191, and its related regulations and amendments from time to time (collectively, “HIPAA”).

HIPAA does not necessarily apply to an entity or person simply because there is health information involved, and HIPAA may not apply to your transactions or communications with Sleep Solutions. To the extent Sleep Solutions is deemed a “business associate” however, and solely in its role as a business associate, Sleep Solutions, may be subject to certain provisions of HIPAA with respect to “protected health information,” as defined under HIPAA, that you provide to Sleep Solutions (“PHI”).

In addition, any medical or health information that you provide that is subject to specific protections under applicable law, rule or regulation (collectively, with PHI, “Protected Information”), will be used and disclosed only in accordance with such applicable laws, rules and regulations. However, any information that does not constitute Protected Information under applicable laws may be used or disclosed in any manner permitted under this Privacy Policy. Protected Information does not include information that has been de-identified or anonymized in accordance with applicable laws, rules or regulations.

By accessing or using any part of the Service, you understand that any information that you submit to Sleep Solutions that is not intended and used solely for the provision of diagnosis and treatment is not considered Protected Information, and will be subject only to our Privacy Policy and any applicable laws, rules or regulations that govern the privacy and security of such information.

For purposes of clarity, information you provide to Sleep Solutions in order to register and set up an account on the Platform, including name, date of birth, username, email address, shipping address, and phone number, are not considered Protected Information.

Collection of Personal Information

The personal information Sleep Solutions collect depends on how you interact with the Platform. 

Sleep Solutions may collect information about you from different sources and in various ways when you use the Platform, including information you provide directly, information collected automatically, information from third-party data sources, and data Sleep Solutions infer or generate from other data.

Information you provide directly. Sleep Solutions collect personal information you provide to us. For example:

  • Name and contact information, such as your name, email address, phone number, and billing and physical addresses.
  • Demographic data, such as your gender and date of birth.
  • Payment information, such as your credit card number, expiration date, CVV number, zip code, bank account information, or other payment details.
  • Sensitive personal information:
    • Government ID, such as your state issued driver’s license number or government identification number, passport number, and social security numbers.
    • Demographic data, such as information about your racial or ethnic origin.
    • Communications, such as the contents of communications that you make via the Service and/or Platform.
    • Biometric information, such as biometric information to verify your identity prior to your use of the Service and/or Platform.
    • Health data, such as information concerning your health. This may include information relating to your browsing activity on the Platform and your use of the Platform, as well as the purchases you make via the Platform, and other interactions between you and the Service and/or Platform.

Information Sleep Solutions collect automatically. When you use the Platform, Sleep Solutions may collect some information automatically. For example:

  • Identifiers and device information, such as your Internet Protocol (IP) address and information about your device, including device identifiers (such as MAC address); device type; and your device’s operating system, browser, and other software including type, version, language, settings, and configuration. As further described in the Cookies section below, our Platform and/or Services may store and retrieve cookie identifiers, mobile IDs, and other data.
  • Geolocation data, such as geolocation data.
  • Usage data, such as the URL of the website from which you came, pages you viewed, how long you spent on a page, access times, and other details about your use of and actions on the Platform. In some instances, such usage data may be sensitive personal information if it relates to your browsing activity on health-related pages on the Platform. For example, Sleep Solutions may log the fact that you visited a page that relates to a specific product or treatment available through our site.

Information Sleep Solutions may create or generate. Sleep Solutions may infer new information from other data Sleep Solutions collects, including using automated means to generate information about your likely preferences or other characteristics (“Inferences”). For example, Sleep Solutions may make Inferences about your general geographic location based on your IP address.

Information Sleep Solutions obtain from third-party sources. In certain instances, Sleep Solutions may also obtain the types of information described above from third parties. These third-party sources include, for example:

  • Third-party partners. Third-party applications and services, including social networks you choose to connect with or interact with through our Platform or other means.
  • Marketing partners. Partners with which Sleep Solutions engages with for marketing activities. 
  • Publicly available sources. Public sources of information such as open government databases.

When you are asked to provide personal information, you may decline. You may also use web browser or operating system controls to prevent certain types of automatic data collection. If you choose not to provide or allow information that is necessary for certain services or features, the Platform, or its features, may not be available or fully functional.

Restrictions on Use by Minors

The Service is generally intended for use by individuals who are at least eighteen (18) years of age or older as may be required by applicable laws, rules and regulations in the jurisdiction in which an individual utilizes the Service. Individuals who are between the ages of thirteen (13) and seventeen (17) (or such older age of majority) may use the Service on under the supervision and consent of a parent or legal guardian in accordance with the requirements set forth in the Terms and Conditions of Sleep Solutions. The Service is not designed or intended to attract, and is not directed to, children under thirteen (13) years of age. If Sleep Solutions obtain actual knowledge that Sleep Solutions has collected personal information through the Platform from a person under thirteen (13) years of age, Sleep Solutions will use reasonable efforts to refrain from further using such personal information or maintaining it in retrievable form.

Furthermore, if you are under sixteen (16) years of age, then you (or your parent or legal guardian if you are under age 13) may at any time request that Sleep Solutions remove content or information about you that is posted on the Platform. Please submit any such request (“Request for Removal of Minor Information”) to either of the following:

  • By mail: Sleep Solutions, Inc., Attn: Privacy Officer, 8431 Hilltop Road Fairfax, VA 22031, with a subject line of “Removal of Minor Information”. If you send by mail, please send by U.S. Certified Mail, Return Receipt Requested to allow for confirmation of mailing, delivery and tracking.
  • By email: help@springsleep.com, with a subject line of “Removal of Minor Information”

For each Request for Removal of Minor Information, please state “Removal of Minor Information” in the email or letter subject line, and clearly state the following in the body of the request:

  • The nature of your request;
  • The identity of the content or information to be removed;
  • The location of the content or information on the Platform (e.g. by providing the URL);
  • That the request is related to the "Removal of Minor Information"; and
  • Your name, street address, city, state, zip code and email address, and whether you prefer to receive a response to your request by mail or email.

Sleep Solutions will not accept any Request for Removal of Minor Information via telephone or facsimile or other method of communication. Sleep Solutions is not responsible for failing to comply with any Request for Removal of Minor Information that is incomplete, incorrectly labeled or incorrectly sent.

Please note that Sleep Solutions are not required to erase or otherwise eliminate, or enable erasure or elimination of such content or information in certain circumstances, such as, for example, when an international, federal, state, or local law, rule or regulation requires Sleep Solutions to maintain the content or information; when Sleep Solutions maintains the content or information on behalf of your Providers (as defined in our Terms and Conditions) as part of your electronic medical record; when Sleep Solutions anonymizes the content or information, so that you cannot be individually identified; when you do not follow the aforementioned instructions for requesting the removal of the content or information; or when you have received compensation or other consideration for providing the content or information.

The foregoing is a description of Sleep Solutions’ voluntary practices concerning the collection of personal information through the Service from certain minors, and is not intended to be an admission that Sleep Solutions is subject to the Children’s Online Privacy Protection Act (COPPA), the Federal Trade Commission’s Children’s Online Privacy Protection Rule(s), or any similar international, federal, state, or local laws, rules, and/or regulations.

Cookies and Similar Technologies

Sleep Solutions use cookies, web beacons, mobile analytics and advertising IDs, and similar technologies to operate the Platform and Services and to help collect data, including usage data, identifiers, and device information.  

What are cookies and similar technologies?

Cookies are small text files placed by a website and stored by a browser on your device. A cookie can later be read when the browser connects to a device in the same domain that placed the cookie. The text in a cookie contains an identifier, such as a string of numbers and letters, that may uniquely identify your device and can contain other information as well. This allows the device to recognize the browser over time, each time it connects to that device. 

Web beacons are electronic images (also called single-pixel or clear GIFs) that are contained within a website, email or other digital format. When the browser opens a format that contains a web beacon, it automatically connects to the device that hosts the web beacon (typically operated by a third party). This allows that device to log information about your device and to set and read its own cookies. Sleep Solutions may also include web beacons in email messages or newsletters to tell us if you open and act on them. 

Mobile analytics and advertising IDs are generated by operating systems and can be accessed and used by apps in much the same way that websites access and use cookies. The Platform may contain software that enables Sleep Solutions and our Partners to access these mobile IDs. 

Use of cookies and similar technologies

Sleep Solutions and our Partners may use these technologies in on our Platform and Services to collect personal information (as detailed herein) when you use the Platform and/or Services. This data is used to store your preferences and settings, enable you to sign-in, analyze how our Platform performs, track your interaction with the Platform and Services, develop Inferences, reduce or prevent fraud and fulfill other legitimate and legal purposes. Sleep Solutions and/or its Partners may also share the data Sleep Solutions collect or infer with third parties for these purposes.

What controls are available?

There are a range of cookie and related controls available through browsers, mobile operating systems, and elsewhere. Sleep Solution provides options for allowing you to select which cookies you wish to allow.

Use of Personal Information

Sleep Solutions uses the personal information collected for purposes described in this Privacy Policy or as otherwise disclosed to you, such as, delivery of products or Services, operating the Sleep Solutions business and Platform (including processing payments and shipping and tracking purchases), improving products and Services, providing customer service and support, communicating with you, and for marketing and advertising purposes. Sleep Solutions combines data collected from different sources for these purposes, and to give you a more seamless, consistent, and personalized experience.

Additionally, Sleep Solutions may use information about your browsing and other activity on the Service and/or Platform to promote and market Sleep Solutions, the Service, the Platform, and the products and/or services offered by Sleep Solutions. Depending on your activity on the Platform, this may include information related to you visiting health-related pages on the Platform. In some states, Sleep Solutions may be required to obtain your consent prior to using information that constitutes sensitive personal information. While Sleep Solutions may use information about your browsing activity on health-related pages, Sleep Solutions do not use Protected Information for advertising or marketing.

Sleep Solutions may de-identify or anonymize your information and use, create, and sell such de-identified or anonymized information for any business or other purpose not prohibited by applicable law, rule or regulation. In cases where our use or sharing of data does not require an ability to identify individuals from the data, Sleep Solutions may de-identify or anonymize that data as a way of protecting privacy and security. Where the process is designed to permanently de-identify or anonymize the data, Sleep Solutions will maintain and use the data only in a de-identified or anonymized form and will not attempt to re-identify it (except for the limited purpose of testing or evaluating the efficacy of the de-identification or anonymization process or as otherwise permitted by law, rule or regulation).

Disclosure of Personal Information

Sleep Solutions may disclose personal information with your consent or as Sleep Solutions determines necessary to complete transactions or provide the Services. Subject to the limitations described herein, Sleep Solutions may disclose each of the categories of personal information described above, to the types of third parties described below, in connection with the provision of the Service or as otherwise permitted or required by law. For example, Sleep Solutions may disclose information about you to:

  • Service providers. Sleep Solutions provide personal information to vendors or agents working on our behalf for the purposes described in this Privacy Policy. For example, companies we’ve hired to provide customer service support or assist in protecting and securing our systems and services may need access to personal information to provide those functions.
  • Marketing/Ad Partners. Sleep Solutions may provide personal information to marketing and advertising partners. For example, Sleep Solutions may disclose identifying information to an advertising partner in order to deliver personalized advertising to you or for the purpose of delivering advertisements to other people with similar interests to you. This may include sensitive personal information such as health data to the extent it is not Protected Information.
  • Financial services & payment processing. When you provide payment data, for example to make a purchase, Sleep Solutions will disclose payment and transactional data to banks and other entities as necessary for payment processing, fraud prevention, credit risk reduction, analytics, or other related financial services.
  • Corporate transactions. Sleep Solutions may disclose personal information as part of a corporate transaction or proceeding such as a merger, financing, acquisition, bankruptcy, dissolution, or a transfer, divestiture, or sale of all or a portion of our business or assets.
  • Legal and law enforcement. Sleep Solutions will access, disclose, and preserve personal information when Sleep Solutions believe that doing so is necessary to comply with applicable law, rule or regulation or respond to valid legal process, including those from law enforcement or other government agencies.
  • Security, safety, and protecting rights. Sleep Solutions will disclose personal information if Sleep Solutions believe it is necessary to: protect our customers and others, for example to prevent spam or attempts to commit fraud, or to help prevent the loss of life or serious injury of anyone; operate and maintain the security of our services, including to prevent or stop an attack on our computer systems or networks; or protect the rights or property of ourselves or others, including enforcing our agreements, terms, and policies.

Third party analytics and advertising companies also collect personal information through our website and apps including identifiers and device information (such as cookie IDs, device IDs, and IP address), geolocation data, usage data, and inferences based on and associated with that data. These third-party vendors may combine this data across multiple sites to improve analytics for their own purpose and others.

Choice and Control of Personal Information

Sleep Solutions may provide a variety of ways for you to control the personal information Sleep Solutions hold about you, including choices about how Sleep Solutions use that data. In some jurisdictions, these controls and choices may be enforceable as rights under applicable law, rule or regulation.

Access, portability, correction, and deletion. If you wish to access, copy, download, correct, or delete personal information about you that Sleep Solutions hold, please visit www.springsleep.com. If you are unable to access, copy, correct, or delete certain personal information Sleep Solutions have via those means, you can send us a request by using contact methods described at the bottom of this Privacy Policy. In some states, you also have the right to request information about third parties with whom Sleep Solutions share your personal information, which you may exercise through these same mechanisms.

Data sales. Some privacy laws define “sale” broadly to include some of the disclosures described in the “Disclosure of Personal Information” section above. To opt-out from such data “sales” you can use the Global Privacy Control setting, visit www.springsleep.com, or click on “Consent Preferences” on the bottom of our webpage

Targeted advertising. If you wish to opt-out of the use of your personal information for targeted advertising, you may do so at www.springsleep.com.

Communications preferences. You can choose whether to receive promotional communications from us by email or SMS. If you receive promotional email or SMS messages from us and would like to stop, you can do so by following the directions in that message or by contacting us at help@springsleep.com. These choices do not apply to certain informational communications including surveys and mandatory service communications.

Data Retention

Sleep Solutions may retain personal information for as long as necessary to provide the services and fulfill the transactions you have requested, comply with our legal obligations, resolve disputes, enforce our agreements, and for other legitimate and lawful business purposes. Because these needs can vary for different data types in the context of different services, actual retention periods can vary significantly based on criteria such as user expectations or consent, the sensitivity of the information, the availability of automated controls that enable users to delete data, and our legal or contractual obligations.

Transactions

In connection with any transaction that you conduct through the Service, you may be asked to supply certain information relevant to the transaction. By submitting such information, you grant Sleep Solutions without charge the irrevocable, unencumbered, universe-wide, and perpetual right to provide such information to third parties (e.g., payment processing companies, buyers on the Service, sellers on the Service) for the purpose of facilitating the transaction.

All credit card, debit card and other monetary transactions on or through the Service occur through an online payment processing application(s) accessible through the Service. This online payment processing application(s) is provided by Sleep Solutions’ third-party online payment processing vendors, Stripe, Shopify, Klarna, Truemed (collectively, “Payment Vendors”). Additional information about Sleep Solutions Payment Vendors, their respective privacy policies and information security measures are available at their websites. Reference is made to the Payment Vendor Policies for informational purposes only and are in no way incorporated into or made a part of this Privacy Policy. Sleep Solutions’ relationship with Payment Vendors, if any, is merely contractual in nature, as Payment Vendors are nothing more than a third-party vendor to Sleep Solutions, and they are in no way subject to Sleep Solutions’ direction or control; thus, their relationship is not, and should not be construed as, one of fiduciaries, franchisors-franchisees, agents-principals, employers-employees, partners, joint venturers or the like.

Jurisdictional Issues

The Service may only be used within certain states within the United States as described in our Terms and Conditions. Accordingly, this Privacy Policy, and our collection, use, and disclosure of information about you, is governed by U.S. law, rule and regulation.

California Privacy Rights

If you are a California resident and the processing of personal information about you is subject to the California Consumer Privacy Act (CCPA), you have certain rights with respect to that information.

Notice at Collection. At or before the time of collection, you have a right to receive notice of our practices. You can find those details in this Privacy Policy.

Right to Know. You have the right to request that Sleep Solutions disclose to you the personal information Sleep Solutions has collected about you. You also have a right to request additional information about our collection, use, disclosure, or sale of such personal information. Note that Sleep Solutions has provided this information in this Privacy Policy. You may make additional “request to know” by emailing us at help@springsleep.com.

Rights to Request Correction or Deletion. You also have rights to request that Sleep Solutions correct inaccurate personal information and that Sleep Solutions delete personal information under certain circumstances, subject to a number of exceptions. To make a request to correct or delete, email us at help@springsleep.com.

Right to Opt-Out / “Do Not Sell or Share My Personal Information”. You have a right to opt-out from future “sales” or “sharing” of personal information as those terms are defined by the CCPA. If you do not wish for us or our partners to “sell” or “share” personal information relating to your visits to our sites for advertising purposes, you can make your request by emailing us at help@springsleep.com. If you opt-out using these choices, Sleep Solutions will not share or make available such personal information in ways that are considered a “sale” or “sharing” under the CCPA. However, Sleep Solutions will continue to make available to our partners some personal information to help us perform advertising-related functions. Further, using these choices will not opt you out of the use of previously “sold” or “shared” personal information or stop all interest-based advertising.

Sleep Solutions do not knowingly sell or share the personal information of minors under 16 years of age.

Right to Limit Use and Disclosure of Sensitive Personal Information. You have a right to limit our use of sensitive personal information for any purposes other than to provide the services or goods you request or as otherwise permitted by law. To opt-out from such additional purposes, you may email us at help@springsleep.com.

You may designate, in writing or through a power of attorney, an authorized agent to make requests on your behalf to exercise your rights under the CCPA. Before accepting such a request from an agent, Sleep Solutions will require the agent to provide proof you have authorized it to act on your behalf, and Sleep Solutions may need you to verify your identity directly with us. Further, to provide, correct, or delete specific pieces of personal information Sleep Solutions will need to verify your identity to the degree of certainty required by law. Sleep Solutions will verify your request by asking you to send it from the email address associated with your account or requiring you to provide information necessary to verify your account. Finally, you have a right to not be discriminated against for exercising these rights set out in the CCPA.

Additionally, under California Civil Code section 1798.83, also known as the “Shine the Light” law, California residents who have provided personal information to a business with which the individual has established a business relationship for personal, family, or household purposes (“California Customers”) may request information about whether the business has disclosed personal information to any third parties for the third parties’ direct marketing purposes.

Please be aware that Sleep Solutions do not disclose personal information to any third parties for their direct marketing purposes as defined by this law. California Customers may request further information about our compliance with this law by emailing help@springsleep.com. Please note that businesses are required to respond to one request per California Customer each year and may not be required to respond to requests made by means other than through the designated email address.
